‏ OMR 12,000 fine and imprisonment Judicial rulings in the case of rotten fish in Dhofar

The Court of First Instance in Salalah has issued a judgment in favor of the consumer protection department in Dhofar against defendants in one of the fish factories for the misdemeanor of dealing with a corrupt commodity and the misrepresentation of the consumer with incorrect information about the commodity, violating the Consumer Protection Law promulgated by Royal Decree No. 66/2014.

 

 

With regard to the facts of the case, the Department received a communication from the Salalah Fishery Research Center about the suspicion that a factory had manipulated the dates of validity of the raw materials involved in the packaging of fish products. The judicial inspectors immediately went to the suspect factory and found an amount of expired raw materials estimated at six tons and two hundred and sixty kilograms. In addition, the inspection of frozen warehouses, where suspicious raw materials were found, samples were sent to municipal laboratories and positive results were found, which means that they are not suitable for human consumption. Accordingly, a team of judicial inspectors and specialists at the Salalah Fish Research Center was formed to inspect the factory's frozen warehouses. It concluded that large amounts of some of them expired according to the data on their containers and others that do not have validity dates. The quantity reached 305 tons. In tracking shipments and record data, the specialists noted that some of the canisters were packaged with fish other than those mentioned in the data card. In the light of this, after collecting the inferences, making the minutes of the question with the suspects and completing the file on the subject, the case file was referred to the public prosecutor, who referred the case to the competent court. The court issued a verdict condemning the defendants in the factory and punish them for the first offense with three months 'imprisonment and a fine of OMR 10,000 and for the second offense with ten days' imprisonment and OMR 2,000fine; the two penalties shall be combined and the most effective shall be implemented.
Ali bin Salem Al Basrawi, Director of the Department of Consumer Protection in Dhofar Governorate, said that the seizure came within the framework of complementarity of roles and synergy between the Authority and other institutions in all that would preserve consumer safety, health and rights. Cooperate with us in this case. It comes also as a confirmation that the Authority is keen to deal with the communications received in all transparency and cooperate with the specialized bodies in the interests of the work to maintain the health and safety of the consumer. It will not hesitate to address all those who do not comply with the provisions of the laws and legislation on consumer protection endangering the lives and health of the consumer at risk. Al-Basrawi pointed out that the Authority calls upon all traders and suppliers to adhere to the credibility and transparency with consumers when providing any goods or services and comply with all provisions of the Consumer Protection Law and its executive regulations and related laws.

 No one imagined that greed and deviousness would reach such a staggering level that thought exist only in movies and investigative drama shows , yet it became a stark reality when some merchants sought to make a profit on the account of health and safety of the young and adults alike utilizing the God-given intellect that they posses into destruction and evil instead of serving public good , the devious plan used ( Back to school ) season by carving holes inside books and hiding chewing tobacco inside in away from the inspectors notice targeting the younger generation with these destructive materials that effect the health , mind and safety of our kids .
 The Judicial officers noticed that consumers come very frequently to a specific shop during one of the inspection tours which raised their suspicions to strengthening the monitoring and follow up on that matter , students were spotted in the shop as well , the Officers expediently intervened to inspect the shop , the inspection did not reveal anything at first , however , the officers noticed a stack of books and decided to inspect it , surprisingly , they found more than 600 pouches of chewing tobacco on its way to be sold and distributed on consumers and students , the officers immediately issued a violation and referred the case to the General Prosecution to deal with the matter as per the Law
