For endangering the safety of consumers The seizure of a commercial establishment that sells vehicle spare parts as original at Seeb

12/09/2019

Through the field visits of the judicial officers, the Consumer Protection Department at Seeb was able to seize one of the commercial establishments that sells counterfeit parts as original after replacing the original piece inside the box with a counterfeit piece. This seizure comes in continuation of the efforts exerted by the Authority's employees in controlling anyone who violates the applicable laws and regulations in all cases that concern the consumer.

Concerning the reasons for the seizure, Ziad Al Wahaibi, Director of Consumer Protection Department in Seeb, said that in the framework of the efforts exerted by the employees of the Department and through the continuous inspection visits to the shops, commercial centers and all commercial institutions that fall within the jurisdiction of the Authority, the judicial control officers noticed that there are counterfeit goods in a commercial establishment that are sold as genuine. After confirming the pieces by the expert of the Authority, they turned out to be counterfeit. This confirms that some establishments are not committed to regulations and laws, and they work to deceive and cheat the consumer in order to achieve significant financial gains. The sale of counterfeit parts has many negative effects on consumer safety, pointing out that Article (7) of the Consumer Protection Law issued by the Royal Decree No. 66/2014 states that “it is prohibited to circulate any adulterated, corrupt, imitated or unauthorized commodity, and it is prohibited to promote it.”

Al-Wahaibi added that after investigating and examining the seized goods were saved in order to complete the case file and referred to the prosecution, stressing that the seized spare parts vary in selling prices compared to market prices.

Al-Wahaibi added that the Department, represented by judicial officers, is continuously working to follow up the markets in order to preserve the health and safety of the consumer and to control all violators of the laws and regulations dealing with consumer issues, calling on consumers to report all abuses in order to take all legal actions against violators.

Engineer Abdul Razzaq Othmani, an expert in mechanical engineering at the Authority, said that they found out through the process of inspection of the types of spare parts seized that the canning process has been performed tightly and a high degree of prestige. He pointed out that it was written on all the spare parts boxes that were manufactured in the country of origin, and the logo of the brands of cars was tightly placed with the use of phosphoric sticker in the latest update of the company.

He added, however, when checking the quality of the piece we find either the symbol of the piece is different from what is on the box or it is anonymous, (there is no name of the manufacturer or the exporting country). In many cases, we found that the box contains a piece completely different from what was written in the box, stressing that the majority of the seized parts represent car brakes and constitute 59.78% of the total spare parts that do not comply with the safety and security specifications, which is harmful to the consumer and his property and road users in general.
