Judicial rulings against violators of the Consumer Protection Law in Northern Al Batinah and financial fines of more than 900 OMR

The Appellate Court and the Primary courts in the states of Al-Suwaiq and Sohar recently issued court rulings against a number of commercial establishments for violating the Consumer Protection Law promulgated by Royal Decree No. 66/2014 ruling convictions and financial fines amounting to 3654 Omani riyals. The facts of the first ruling are summarized in the Public Directorate of Consumer Protection in North Al Batinah Governorate receiving a complaint from one of the consumers stating that he had agreed with a commercial institution in the state of Al-Suwaiq to build a house, so he paid it an amount of (1550) Omani riyals, but it did not do any work for more than three Months and he agreed with it to cancel the contract with a refund, but the institution did not commit to that either.

 

The owner of the institution refused to cooperate with him, which prompted him to submit his complaint to the Directorate, which took the necessary measures in regard to such cases, and then the complaint was referred to the Public Prosecution in Al-Suwaiq, which began its investigation and referred it to the Primary Court. Where she issued a judgment in absentia that the defendant was convicted of a misdemeanor in violation of the Consumer Protection Law for not committing to the agreed service and fined him (500) Omani Rial, and ordered the suspension of the sentence imposed in the event that the accused settles with the complainant within a month of the date of the final ruling of the judgment, and obliges him with judicial expenses, and he has The right of the opposition to rule during the legal period. 

The facts of the second ruling are also summarized in the Directorate receiving a complaint from one of the consumers, in which he stated his agreement with one of the commercial establishments in Sohar to detail and install doors and windows for his house according to a contract concluded between them in the amount of (380) Omani riyals according to the fixed bill in the English language, but it became clear that the doors that were Delivered violate the specifications and the required form for that, he returned them, but the institution did not commit to return the amount or supply the same required doors, which prompted the consumer to submit his complaint to the directorate that referred the complaint to the Sohar Public Prosecution, which initiated the investigation and referred it to the court of first instance State. Where it decided to convict those accused of a misdemeanor of non-commitment to transparency and credibility in dealing with the consumer and the misdemeanor of non-commitment to provide the consumer with a bill written in the Arabic language, and ruled to punish them for the first fine (2000) Omani riyals, and for the second fine (100) Omani riyals, the two lighter penalties in the most severe that The maximum amount of (100) Omani Rial shall be executed for each of them.

 

The details of the third ruling are summarized in the Directorate receiving a complaint from one of the consumers, in which he stated that he had contracted and agreed with one of the institutions that works to print the bags and dining plastic cover, where he contracted with her to print bags and the dinning covers with a total amount of (2050) Omani Rial in which he paid an amount of (1050) (RO). However, the institution did not submit the work agreed upon and after the complaint, contact was made with the owner of the institution (the accused), and it was agreed to return the amount paid in installments, but the accused did not abide by the agreement and returned only (250) RO of the total amount. Accordingly, the Directorate took the followed procedure in such cases, where the file was referred to the public prosecutor, who in turn initiated the investigation of the case and referred it to the Sohar Court, which issued a court ruling to convict the defendant of the offense of non-compliance with the service, and not to return its value, and ruled that he be punished with a fine (200) Omani Rials and Civilians, compelling him to return the amount to the plaintiff in the civil right amounting to (754) Omani Rials, and obliging him to pay the expenses, and to refer the remaining requests to the competent civil court.

 No one imagined that greed and deviousness would reach such a staggering level that thought exist only in movies and investigative drama shows , yet it became a stark reality when some merchants sought to make a profit on the account of health and safety of the young and adults alike utilizing the God-given intellect that they posses into destruction and evil instead of serving public good , the devious plan used ( Back to school ) season by carving holes inside books and hiding chewing tobacco inside in away from the inspectors notice targeting the younger generation with these destructive materials that effect the health , mind and safety of our kids .
 The Judicial officers noticed that consumers come very frequently to a specific shop during one of the inspection tours which raised their suspicions to strengthening the monitoring and follow up on that matter , students were spotted in the shop as well , the Officers expediently intervened to inspect the shop , the inspection did not reveal anything at first , however , the officers noticed a stack of books and decided to inspect it , surprisingly , they found more than 600 pouches of chewing tobacco on its way to be sold and distributed on consumers and students , the officers immediately issued a violation and referred the case to the General Prosecution to deal with the matter as per the Law
